PBSA and the Renters’ Rights Act

How UK purpose-built student accommodation sits against the Renters’ Rights Act 2025, approved codes, and the checks buyers should run.

What the Act is, and why PBSA is different

PBSA regulations in England now sit against the Renters’ Rights Act 2025, the primary statute reforming the private rented sector. The Act is aimed at assured tenancies and landlord conduct in general residential lettings. Purpose-built student accommodation is designed and let as an academic-year occupational product, often with an on-site operator and, on some schemes, a university nomination.

That product difference is why investors ask about a student exemption. The correct question is narrower: which provisions apply to this occupation contract, this landlord, and this operator? A “PBSA” brand on the building does not answer it.

UK coverage: 1,849 active schemes across 78 cities (62 cities with a hub page). As of 20 October 2026. These are PBSAX coverage figures, not a national census. See PBSA news for the dated snapshot, and city pages under UK PBSA.

Approved codes and operator practice

Larger UK schemes commonly belong to the ANUK/Unipol National Codes. The codes set standards and a complaints route for purpose-built student housing. Buyers should confirm current membership for both the provider and the day-to-day manager, and whether membership is a condition of any statutory treatment they are relying on.

Operator duties live in the management agreement. University occupancy contracts are nomination agreements. City context is on UK PBSA, including London and Manchester.

FAQs

Does the Renters’ Rights Act apply to PBSA?

The Renters’ Rights Act 2025 reforms the private rented sector in England. Whether a given purpose-built student scheme sits inside or outside particular provisions depends on the occupation contract, who the landlord is, and any exemption or commencement instrument. Do not assume a scheme is exempt because it is labelled PBSA.

Why do operators talk about ANUK and Unipol?

The ANUK/Unipol National Codes are the main UK quality and complaints framework for larger purpose-built student schemes. Membership is a common diligence signal and can be relevant to how a scheme is treated under housing rules. Confirm current membership for the provider and the manager.

Is a student licence the same as an assured tenancy?

Often no. Many PBSA rooms are let on academic-year licences or operator-specific contracts, not standard assured tenancies. The label on the document is not enough — counsel should map the actual occupation agreement to the statute.

What should buyers check on regulation?

Occupation contract form, operator code membership, university nominations, HMO or licensing exposure on any non-purpose-built element, and Building Safety duties. See the tax and regulation guide for SDLT, VAT, and planning.

Does this page give legal advice?

No. It is general information for investors and operators. The Act, commencement regulations, and your contracts decide the position. Take advice on the specific scheme.
