Two regimes, one building
Building safety and fire on PBSA are not a single badge. In England the Building Safety Act 2022 created a regulator and extra duties for higher-risk buildings. The Fire Safety Order still requires a suitable fire-risk assessment on a much wider set of premises. Owners need both files.
A tall scheme in London may be higher-risk. A lower block in Newcastle may not — and still needs a current FRA, a competent operator, and a works plan if the survey finds defects.
UK coverage: 1,849 active schemes across 78 cities (62 cities with a hub page). As of 20 October 2026. These are PBSAX coverage figures, not a national census. See PBSA news for the dated snapshot, and city pages under UK PBSA.
What owners should hold
On a higher-risk building, accountable persons must manage building-safety risks in occupation and keep prescribed information. Residents can raise concerns with that person and, if ignored, with the Building Safety Regulator. Design-stage duties sit with dutyholders — see the architecture guide. Occupation and operator practice sit in the management agreement.
| Check | What to confirm |
|---|---|
| Higher-risk status | Height, storeys, and use against the statutory test. |
| Accountable person | Who is registered and what the operator actually does. |
| Information | Safety case, golden-thread records, and resident-engagement duties. |
| Fire | Current FRA, compartmentation, and any waking-watch or temporary measures. |
| Works | Cladding, alarms, or other programmes already priced or still open. |
| Insurance | Whether cover assumes works that have not finished. |
Energy and welfare sit on ESG in PBSA. Housing-reform questions sit on Renters’ Rights. Acquisition process is in due diligence.
Why this moves value
Incomplete information, temporary fire measures, or an unpriced works programme will show up in insurance, in lender conditions, and in the bid. Do not invent a national remediation cost. Price the building in front of you. Dated market coverage is on PBSA news. Operating-cost treatment of works is on operating costs and NOI.

FAQs
Does the Building Safety Act apply to PBSA?
The Building Safety Act 2022 is the statute for building safety in England. Higher-risk building duties attach when the building meets the statutory height and use tests. Many student schemes will qualify; some will not. Confirm status from the drawings and the regulator’s criteria, not from a brochure.
What is an accountable person?
On a higher-risk building, the accountable person is responsible for assessing and managing building-safety risks in occupation and for keeping prescribed information. Owners should know who that is and whether the operator is only a manager.
Do fire-risk assessments apply if the building is not higher-risk?
Yes. The Fire Safety Order duties on assessing and managing fire risk apply much more widely than the higher-risk building regime. A current FRA belongs in every bid file.
Who pays for historical safety defects?
The Act and later regulations allocate remediation costs and create routes to hold those responsible to account. On a purchase, treat outstanding cladding or compartmentation works as a price and reserve issue.
Is this legal advice?
No. This page is general information for owners, operators, and lenders. Status, duties, and cost allocation must be confirmed on the specific building.
